The Takings Issue in Billboard Control

Abstract 

Reducing billboard clutter in a community is a difficult task, and one that is bitterly opposed by the outdoor advertising industry. One way to do so, and perhaps the most effective way, is to ban the construction of new billboards, thus reducing the number of billboards as some are removed for development or other reasons.

Billboard Legislation and the Takings Issue

Abstract

Over the past few years there has been a determined effort by the billboard industry to secure state legislation reducing the rights of local governments to require removal or alteration of billboards along local roads. The industry has been richly rewarded as a result, but the adverse consequences to the public welfare are now just becoming visible.
